- Navigate to the Matters tab.
- Select the Create Matter button located at the top right corner of the matters list.
- In the Create Matter page, fill in required fields and optional fields, as necessary.
Required Fields
Please see below for an overview of the required fields:
- Name: The desired name assigned to the matter.
- Email Subject: The subject of the email sent to custodians receiving hold notices. By default, the Email Subject will be blank.
- Case Type: The Case Type determines which users have access to the matter, as defined in the user permissions. Default types include claim, consumer class action, copyright, employment, insurance, investigation, litigation, patent, and trademark.
- Stage: Current stage of the mater. Default stages include Litigation and Pre-Lit.
- Attorney: The attorney handling the matter. This list is populated with users who are assigned as an attorney user and have permissions to view the selected Case Type.
- Custodians: Employees who are being placed on legal hold for the matter. Please see the Adding Custodians to a New Matter Knowledge Base on instructions on how to add custodians.
- Status: DISCO Hold supports a Draft → In Review → Kickback → Open workflow. The Status selection will determine where the matter is placed in this workflow.
- If Save Draft is selected, the matter will be placed in Draft status and all progress saved. The attorney and custodians will not be notified, and no holds will be placed in source.
- If Send Draft for Review is selected, the matter will be placed in In Review status and all progress saved. No custodians will be notified or holds placed in source, but the attorney will be notified that the matter is ready for their review.
- If Publish FINAL Hold is selected, the matter will be placed in Open status. Holds will be placed in source and all public custodians will receive the hold notice. Matters that have been placed in Open status cannot be returned to Draft, In Review, or Kickback status.
Optional Fields
Please see below for an overview of key optional fields:
- Notice Template: Use the dropdowns to select a Notice Template to populate the email public custodians will receive. Use the text box to the left to populate and make changes in the template. Please see the Creating a Notice Template Knowledge Base on instructions on how to create a Notice Template
- Email Attachments: Email attachments will be sent to all custodians who receive a hold notice. Up to 5 documents can be attached, totaling up to 8 MB. The following formats may be used: CSV, DOC, HTML, JPEG, PDF, PNG, PPT, and XLS.
- Global Automated Reminder: If Global Automated Reminder is set to Yes, public custodians will receive a reminder on a monthly, quarterly, or bi-annual basis (depending on the interval selected) that reminds them they are on hold and should not delete any materials.
- Notice Only: If Notice Only is set to Yes, public custodians will receive the finalized hold notice but no holds will be created in source. By default, Notice Only is set to No.
- Questionnaire: When the matter with a Questionnaire is placed into Open status, public custodians will be prompted to complete questionnaires upon acknowledgment of the matter. At this time, DISCO Hold only supports free-text questions and answers. A questionnaire may be added to the matter by selecting the Add Questionnaire button and opening the add questionnaire panel. A Questionnaire Template may be selected from the dropdown options, which will cause the questions contained in the chosen template to populate. Questions may also be added by entering text in the ‘Write a New Question’ field and clicking Add. Questions may be removed by clicking the X to the right of the question. - Acknowledgement Reminder: If Acknowledgment Reminder is set to Yes, custodians will be emailed a reminder to acknowledge the matter on a daily or weekly basis, depending upon which is selected. Custodians will continue to receive acknowledgment reminders until they complete the notice acknowledgment process. An acknowledgment reminder can only be selected if Require Acknowledgment is set to Yes.
- cc Non-Custodian Recipients: Email addresses inputted here will receive a copy of the hold notice when the matter is placed in Open status, but no holds will be created in source as the recipient is not considered a custodian. Notice recipients need not be DISCO Hold users.
